Terms and Conditions (Fluency Lab)

1.Introduction and Acceptance of Terms
These Terms and Conditions (“Terms”) govern the contractual relationship between Mandarin Blueprint, LLC (“Mandarin Blueprint,” “we,” “us,” or “our”) and the individual enrolling in the Fluency Lab program (“Member,” “you,” or “your”) with respect to your enrollment and participation in the Program.
By enrolling in Fluency Lab, paying the enrollment fee, or accessing any part of the program, you confirm that you have read and understood these Terms and agree to be bound by them. If you do not agree, please do not proceed with enrollment.
Privacy Notice. Your use of Fluency Lab is also subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By enrolling, you confirm that you have reviewed our Privacy Policy and accept its terms.
2. Program Features
Fluency Lab is designed to help you make clear, measurable progress toward Mandarin fluency through a structured daily study plan, weekly speaking practice, and ongoing coaching and guidance. The program includes the following core features. We may update, adjust, or expand these features from time to time and will notify you of any material changes.
2.1. Learning Materials Access
Upon enrollment, you will receive access to Mandarin Blueprint’s full course library, including The Blueprint, Pronunciation Mastery, the Mandarin Speaking and Listening Kickstarter, and The Phrase Vault. You will also receive access to any new course content released during your active subscription.
2.2. Fluency Coaching
Upon enrollment, you will be assigned a dedicated Fluency Coach. Your Fluency Coach is a fluent (B2+) non-native Mandarin speaker with expertise in linguistics, language acquisition, and coaching. They will provide accountability and will do their utmost to ensure a high-quality experience in the program. Your Fluency Coach provides ongoing support and will guide you in setting goals and creating a study plan. They will also provide occasional check-ins to provide accountability and adjust your plan.
When you enroll, you will have a one-on-one Fluency Roadmap call (approximately 30 minutes) with a Fluency Coach. On this call, your coach will assess your current level and available study time and map out a realistic path from where you are to real fluency (CEFR B2+).
2.2. Native Speaker Practice
Fluency Lab includes weekly speaking sessions with native Mandarin tutors. Each session is 30 minutes and conducted via Zoom (or a comparable video platform). Sessions follow a structured curriculum aligned with your progress.
2.4. Language Islands
Each month, you will receive an allocation of Language Island sentence credits as part of your subscription. You may also purchase additional credits if you wish.
2.5. Community and Coaching Support via Skool
You will have access to the Fluency Lab community on the Skool platform, where you can ask Mandarin-related questions at any time. Our coaches and support team will use reasonable efforts to respond to posts in a timely manner during normal business days.
Check-In threads are posted by the coaching team and are the primary channel for ongoing coaching support.
3. Enrollment, Subscription, and Access
3.1. One-Time Enrollment Fee
To join Fluency Lab, a one-time Enrollment Fee of $2,000 USD (“Enrollment Fee”) is required. Upon payment of the enrollment fee, you will have immediate access to the full Fluency Lab program, including your Fluency Roadmap onboarding call, tutoring sessions, Language Island credits, and access to Mandarin Blueprint’s core course materials. After your first month, continued access to coaching, tutoring sessions, and Language Island credits requires an active subscription.
3.2. Subscription options and Plan Changes
After paying the enrollment fee, you must select one of two subscription plans to access the full Fluency Lab program:
(a) Monthly subscription. A recurring payment billed every four weeks, providing continued access to your Fluency Coach, native tutor sessions, Language Island credits, and community support.
(b) Annual subscription. A single upfront payment covering twelve months of the full program. Annual subscribers receive the same weekly coaching and tutor sessions as monthly members, plus a discount on the monthly rate and additional bonus credits and sessions as confirmed in your enrolment documentation.
Subscriptions renew automatically unless you cancel before the renewal date. After the end of your current subscription period, you may switch between the monthly and annual plan at your next renewal. For example, you can upgrade from monthly to annual (pro-rated pricing may apply) or switch back at the end of the year. No penalty will be applied for making a plan change at a renewal.
3.3. Payment methods and Currency
You may pay via our secure online processors such as Stripe or PayPal. Full payment details will be provided during enrollment. All payments must be made by the method we specify.
All fees are stated in USD and are exclusive of any applicable taxes (you are responsible for your local taxes if any).
3.4. Lifetime Access to Core Materials
If your subscription lapses or you choose not to maintain an ongoing subscription after paying the Enrollment Fee, you retain lifetime access to Mandarin Blueprint’s core course content, including The Blueprint, Pronunciation Mastery, the Mandarin Speaking and Listening Kickstarter, The Phrase Vault, and your Language Island materials and flashcards created during your membership.
In addition, you will have access to the Fluency Lab community on Skool. We reserve the right to remove or restrict your community access at any time for conduct that violates these Terms after your subscription has ended. This applies to all members, both those with active subscriptions and inactive subscriptions. Any conduct that our team deems inappropriate for the community may result in the loss of access to that community, and we reserve the right in our sole discretion to deem behavior as such.
If you later resume a subscription, you will regain access to the live program features as described above.
3.5. Failed Payments and Late Payments
If a scheduled subscription payment fails, we will notify you and attempt the charge again. If payment cannot be collected within seven days of the due date, your active subscription benefits will be suspended until the payment is resolved. Please contact us at [email protected] if you are having payment difficulties. If an account remains in arrears for more than 7 days, we reserve the right to terminate the subscription. Any outstanding balance remains due.
4. Refund and Cancellation Policy
4.1. Trial Period and Refunds
When you enroll in Fluency Lab, you have a 30-day trial period during which you may request a full refund of all amounts paid, including the enrollment fee and any subscription charges, if the Program is not the right fit for you. To request a refund within the trial period, contact us in writing at [email protected] before the 30-day period expires. Please include your full name, the email address associated with your account, and your enrollment date. We will process your refund promptly.
After the 30-day trial period has passed, all payments are non-refundable. This applies to both monthly and annual subscriptions. Mandarin Blueprint may, at its sole and absolute discretion, consider refund requests after the trial period in genuinely exceptional circumstances.
4.2. Cancellation of Your Subscription
You can cancel your subscription at any time by emailing [email protected] or by sending a private message to the support team within the Fluency Lab Skool community. You do not need a reason to cancel and are not required to speak with anyone before doing so. However, we do offer a short optional call for members who want to discuss their situation and explore whether an adjusted plan might work better.
After you cancel, your access to subscription benefits continues until the end of your current paid period. If you cancel a monthly subscription mid-cycle, you retain access for the rest of that four-week period. If you cancel an annual subscription mid-year, you retain access until the end of the twelve-month term. No prorated refund is given for unused time.
Your lifetime course access continues after cancellation, as described in Section 3. This includes continued access to our app, your Language Island audio and flashcards, and all core course materials. Unused Language Island credits remain valid for three months after the end of your paid period, after which they expire.
4.3. Cancellation and Returning to the Program
We do not offer a formal pause or freeze option. If you need to step away from the Program for any reason, you may cancel your subscription and resubscribe when you are ready to resume. We will make reasonable efforts to preserve your progress, notes, and materials for as long as practicable. Upon rejoining the Program, your Fluency Coach and tutor will review your preserved record, including your coach and tutor notes, Language Island materials and flashcards, and course progress, and pick up as close to where you left off as the Program allows at that time. To resume the Program, select the subscription plan of your choice. You will not need to pay the enrollment fee again.
5. Member Responsibilities
5.1. Scheduling of Sessions
The Mandarin Blueprint team will work with you to schedule your native speaker sessions. Please use the provided scheduling tools and communicate promptly to confirm your session times.
If you need to reschedule a session, please give at least 24 hours’ notice by emailing [email protected] or messaging the Mandarin Blueprint team in Skool. Sessions rescheduled with sufficient notice will be carried over within the same billing cycle at no penalty.
If you miss a session or need to cancel last minute, please let us know as soon as possible and we will do our best to find a solution. Where possible, we will offer a rebooking within the same billing cycle. Repeated no-shows without communication may result in the session being forfeited.
5.3. Punctuality
Please join your sessions on time. If you are running late, let us know and we will do our best to accommodate you. Please note that sessions will end at the originally scheduled time regardless of a late start. If you are more than 15 minutes late without prior notice, the session may be treated as missed at the tutor’s discretion.
5.4. Active Participation
Fluency Lab is a guided program and your results depend fundamentally on your effort and consistency. You are expected to attend your scheduled sessions and to communicate with the Mandarin Blueprint team if you experience any difficulties or are falling behind. We are here to help and the sooner you reach out, the sooner we can get you back on track.
Members who disengage without communication for 60 consecutive days may be treated as having abandoned the Program. In such circumstances, we will attempt to contact you before taking any action. If we do not hear back within a reasonable period, we reserve the right to suspend or close the account. All fees remain non-refundable in such circumstances.
5.5. Technology Requirements
Because Fluency Lab includes online sessions and digital materials, ensure you have the necessary technology to participate in online coaching sessions and course activities. At minimum, you will need a stable internet connection and an appropriate device, such as a computer or tablet with a microphone and webcam for live video calls. You are also responsible for installing or accessing any required software or platforms we use. We will inform you of the tools and platforms in advance; please make sure to set them up and familiarize yourself as needed.
5.6. Accurate Information
You agree to provide true, current, and complete information to us during the enrollment process and throughout your participation. This includes your identity, contact details, payment information, and any other personal details requested. If any of your information changes, you must promptly update us. You must not misrepresent your identity or affiliations. Your enrollment is personal to you; you cannot enroll under someone else’s name or allow someone else to pose as you in the Program.
5.7. Timely Payments
You commit to keeping your payment details current and making all payments on schedule. If you anticipate difficulty meeting a payment, please contact us proactively at [email protected] before the due date.
5.8. Communication
Keep open communication with us. If you are unable to attend a scheduled session or will be unavailable for a period of time, please notify us as soon as possible. Additionally, if you encounter any problems with the Program, let us know so we can assist you. We may also periodically ask for feedback on your experience. Providing honest feedback helps us improve the Program. While feedback is appreciated, we do ask that any criticism or suggestions are delivered respectfully.
6. Prohibited Activities
By enrolling in Fluency Lab, you agree not to:
(a) Use the Program, our platforms, or any Program resources for any unlawful or fraudulent purpose;
(b) Share, resell, distribute, or reproduce Mandarin Blueprint’s course materials, session recordings, or other proprietary content with any person who is not enrolled in the Program;
(c) Share your login credentials or allow any other person to access the platform through your account;
(d) Create derivative works based on our content, curricula, or teaching methods without our prior written permission;
(e) Engage in harassment, abusive conduct, discriminatory remarks, or any behavior that creates a hostile environment for coaches, tutors, staff, or fellow members;
(f) Interfere with, disrupt, or attempt to compromise the security or functionality of our platforms, systems, or services;
(g) Impersonate any person or misrepresent your identity or affiliation in any context within the Program.
(h) Submit or upload content through the Language Island builder that is obscene, sexually explicit, violent, abusive, or otherwise inappropriate or offensive, including content that would violate applicable laws or the rights of third parties.
A breach of any of these prohibitions constitutes a material breach of these Terms. We reserve the right to terminate your enrollment immediately and without refund, and to pursue any available legal remedies. Where a member submits inappropriate Language Island content, we reserve the right to decline to translate or process such submission and remove it from our systems without notice.
7. Recordings and Promotional Consent
7.1. Session Recordings
We may record interactions that take place as part of the Fluency Lab program. This includes, but is not limited to, your Fluency Roadmap onboarding call, native speaker tutoring sessions, and any calls or interactions with the Mandarin Blueprint team. By enrolling in and participating in the program, you acknowledge and consent to such recordings being made.
Recordings are stored securely and used for internal purposes only, including quality assurance, training, and to support your progress through the program. All such recordings are handled in accordance with our Privacy Policy.
7.2. Marketing Use of Video Footage (Voluntary Opt-In)
We may wish to use examples of member progress, such as short video clips of members speaking Mandarin, in our marketing and promotional materials. We will never use your image, voice, or performance in any public marketing without your explicit prior consent.
If we ask for a testimonial or recording for marketing purposes, that request will be made separately from these Terms through a dedicated consent form. You are free to decline without any consequence to your membership. Your choice will not affect the quality of service you receive in any way. Please refer to our Privacy Policy for further details on your rights and how we handle any content collected for this purpose.
8. Intellectual Property Rights
8.1. Ownership of Materials
All content and materials provided through Fluency Lab, including The Blueprint course, Pronunciation Mastery, the Kickstarter, The Phrase Vault, Language Island translations and audio we produce for you, session recordings, coaching notes, and all related materials, are the intellectual property of Mandarin Blueprint, LLC or its licensors. Aside from the limited license granted to you for your personal use, no ownership or rights are transferred to you by virtue of your enrollment in Fluency Lab.
8.2. Your License to Use; No Derivative Works
By enrolling and paying the applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Program materials for your own private study purposes only. This license does not permit you to copy, distribute, share, record, or reproduce any materials for any purpose beyond your own personal use. Your Language Island audio files and flashcards generated during your membership are yours to keep and use for your personal practice. However, the underlying translation process, methodology, and any original content within those materials remains our property.
You may not create derivative works from our content, including summaries, translations, adaptations, courses, or products based on our materials, without our prior written consent.
8.3. Infringement and Misuse
Violation of these intellectual property provisions may result in immediate termination of your enrollment without refund, and we reserve the right to pursue legal remedies to the full extent permitted by law.
9. Disclaimers and Limitation of Liability
Fluency Lab is provided on an “as is” basis. We make no guarantees about the results you will achieve or the time it will take you to reach fluency. Progress depends on your own effort, consistency, and starting level, all of which are outside our control. We disclaim all warranties, express or implied, including any guarantee of specific outcomes.
To the maximum extent permitted by law, Mandarin Blueprint’s total liability for any claim arising from these Terms or your participation in Fluency Lab is limited to the amount you have paid us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages. We are also not responsible for the content, advice, or conduct of third-party tutors or platforms; any third-party service used within Fluency Lab is used at your own risk.
10. Program Changes and Update to Terms
Mandarin Blueprint is committed to improving Fluency Lab over time. Accordingly, we may add new features, update or retire existing content, adjust the Program structure, and integrate new tools and technologies. We will communicate changes that materially affect your experience by email and/or through the Skool community with reasonable advance notice. Minor improvements, corrections, and content updates may occur without specific notice and are part of how we keep the Program current. If we discontinue a core feature without providing a meaningful substitute, we will notify you and, where appropriate, reflect the change in your subscription pricing going forward.
We may also update these Terms from time to time to reflect changes in the Program, applicable law, or our operations. If we make material changes, we will notify you by email and/or through the Skool community at least fourteen days before the changes take effect. The “effective date/Last Updated” date at the top of these Terms will be updated accordingly. Your continued participation in Fluency Lab after the effective date of any update constitutes your acceptance of the revised Terms. If you do not agree with a material change, you may cancel your subscription before the new Terms take effect.
11. Governing Law and Dispute Resolution
11.1. Governing Law
These Terms and Conditions, and any dispute or claim arising out of or related to them or your participation in Fluency Lab, shall be governed by the laws of the State of Nevada, USA, without regard to its conflict of laws principles. This choice of law will apply regardless of the country or state in which you reside or access the Program.
11.2. Dispute Resolution and Forum
In the event of any dispute, claim, or controversy arising out of these Terms, we strongly encourage attempting to resolve the issue informally and in good faith. If we cannot resolve a dispute through ordinary communication, you agree that any legal action, lawsuit, or proceeding will be brought in the appropriate state or federal courts located in Nevada. By agreeing to these Terms, you are consenting to the personal jurisdiction of those courts for the purpose of litigating such disputes.
11.3. Class Action Waiver
All claims must be brought individually. You and Mandarin Blueprint, LLC waive the right to participate in any class, consolidated, or representative action. The court may not join or consolidate claims without our mutual written consent.
12. Miscellaneous
12.1. Force Majeure
Mandarin Blueprint will not be in breach of these Terms, nor liable for any delay or failure in performance, where such delay or failure arises from circumstances beyond our reasonable control. This includes, without limitation, natural disasters, internet or platform outages, global health emergencies, government actions, or other events that could not reasonably have been anticipated or prevented. We will make reasonable efforts to resume normal service as soon as practicable and will communicate with you about any material disruption.
12.2. Third parties
These Terms do not give rights to any third parties. You may not assign or attempt to assign your rights and obligations without our express consent.
12.3. Headings
The headings in these Terms are included for convenience only and shall not affect the interpretation or construction of the Terms.
12.4 Severability
If any provision of these Terms is or becomes invalid, illegal or unenforceable in any respect, it shall be ineffective to the extent of such invalidity, illegality or unenforceability and the remaining provisions of these Terms shall remain in effect.
12.5. Waiver
No failure or delay by Mandarin Blueprint in enforcing any provision of these Terms will be deemed a waiver of that right. A waiver of any breach does not constitute a waiver of any subsequent breach of the same or any other provision.
12.6. Entire Agreement
These Terms, together with our Privacy Policy and any enrollment confirmation provided to you, constitute the entire agreement between you and Mandarin Blueprint with respect to your participation in Fluency Lab. They supersede all prior discussions, representations, and understandings between the parties, whether written or oral.
